Reservations for accommodation by Guests (the Guest) are accepted by the Property Owners J Hitchings Partners (the Owner). The Property is West Barn Lodge near Fovant Salisbury Wiltshire SP3 5LL (the Property).
The Agreement: The rental agreement is between the Guest and the Owner. The contract is deemed to have been made once the Guest has paid the booking deposit and the Owner has dispatched a confirmation of booking. The Guest must be over 18 years of age at the time of booking.
Booking The Guest who makes the booking is deemed to have agreed to these Terms and Conditions and will be responsible for all persons included in the booking and should ensure that they are all aware of these Terms & Conditions.
The Owner reserves the right to decline any booking or refuse to hand over a key to any person who has not complied with these Terms & Conditions.
Payment: For bookings made more than 6 weeks before arrival, a booking deposit (part payment) of 25% of the total cost of the rental fee, is required. The balance is due 6 weeks before the holiday commences along with a returnable deposit for damages. For bookings made less than 6 weeks before arrival, the total amount is payable in full on booking.

The Guest agrees to pay the balance of the payment FOUR (4) weeks before the holiday is due to start. Email reminders will be sent, please check your spam in case of details being misplaced, although being sent delivery cannot be guaranteed. Where a Guest fails to pay their balance by the due date the booking may be cancelled and the deposit retained
Accommodation Pricing: Once the Guest has paid the booking deposit the price of the accommodation will not be subject to any change.
Value Added Tax (VAT) is included in the rental price, the Owner will supply the Guest with a VAT invoice/receipt for all bookings. If the rate of VAT changes between the date the Guest submits the booking and the Guests stay, the Owner will adjust the rate of VAT payable unless the Guest has already paid in full before the change of VAT rate takes effect.
Occasionally the Owner, despite best efforts might price a booking incorrectly. The Owner will normally check prices before accepting a booking. Where the correct price at the date of booking is less than the Owners stated price, the Owner will charge the lower amount. If the correct price at the date of the booking is higher than the price stated, the Owner will contact the Guest prior to accepting the booking. The Owner will only honour a lower price if quoted in writing. If the Owner accepts a Guests booking where there was an obvious pricing error, and recognisable as mispricing, the Owner may end the contract and refund the Guest any sums paid.
Returnable Deposit: The Owner reserves the right to charge the Guest a returnable deposit payable to J Hitchings Partners. The minimum deposit being £500 for short stays and longer stays a minimum £1000. The Owner will inspect the Property on departure of the Guest and if required deduct the cost of any breakages and damages prior to returning the deposit sum. Accidents happen and the Owner understands this, the Guest should notify the Owner of any breakages whilst occupying the Property.
Cleaning: The Guest is responsible for leaving the accommodation in good order and in a clean condition; otherwise a cleaning charge will be levied and deducted from the damages deposit. Please note that the convention for UK Holiday cottages is that Guests are expected to leave the Property in a similar state to which they find it (reasonable cleaning excepted). Please abide by this convention so we can continue to provide good value for Guests.
Number of People using Holiday Accommodation: The Owners permit the Guest and members of the Guest's party (but no one else) to occupy the Property for holiday purposes only. The Guest must declare the correct number of additional Guests during booking and, if this changes, must inform the Owner before the rental commences of any change. No more than the maximum number of persons stated on the website may occupy a Property unless by prior written agreement with the Owner. Extra charges may be applicable if the number of Guests differs from the number on the booking
Arrival/Departure: The Property (unless otherwise stated in the Property details) is available for occupation from 4.00 pm on the first day of the holiday and must be vacated by 10.00 am on the last day.
Cancellation or Changes by the Guest: Once the holiday is booked the Guest has entered into a legally binding contract. If the Guest cancels, for whatever reason (including medical and weather related) then no refund of the deposit will be due, and within 6 weeks of the holiday no refund of the full balance is due. A holiday cancellation protection plan should be taken out to cover forced cancellations.
We recommend and expect that the Guest will have or will take out a holiday insurance policy (which includes cancellation insurance covering sickness and unavoidable reasons for cancellation) prior to their stay.
Pets: It is preferred that pets are not brought to the Property, although the Owners at their discretion may allow up to two well behaved dogs to accompany the guests. Cats are not permitted. The Guest may only bring dog/s by agreement and must be registered by the Guest at the time of booking. A cleaning charge of £30 inclusive of VAT will be levied per dog. Pets must be well-behaved and should not be left unattended in the Property. They are not permitted in the bedrooms or on any furniture in the Property. If damage or extra cleaning is caused by pets the Guest will be billed for that charge.
Where the Owner has consented to permit a dog within the Property, the Guest agrees to be responsible for the cleaning of the Property and immediate outside areas before the departure so as to remove all traces of the animal being at the Property. This includes dog mess. If dog mess is found within the Property or in the immediate outside areas after the Guests departure, the Guest will be deducted a cost of cleaning from the returnable deposit.
if it is found that dogs have been permitted on the beds or furniture during the Guests stay or damage has been caused to fixtures and fittings at the Property, the cost to clean and repair will be deducted from the returnable deposit. If the damage incurred is greater than the sum of the returnable deposit, the Guest will be invoiced for the additional amount.
Guest Responsibility:The supervision of children, babies, dogs and any adults requiring care remains the responsibility of the Guest at all times. The Property has a hot tub spar fitted which Guests are permitted to use when it is available. It is the Guests responsibility to ensure that should children be allowed to use this facility, that they are supervised by an adult at all times. The use of the hottub by inebriated Adults is not permitted by the Owner. It is not the responsibility of the Owner should the Guests not adhere to the safety warnings for use of this facility.
Guests should put all furniture etc back to where it was at the beginning of the rental period. Should soft furnishings be taken or used outside they must immediately be put back undercover afterwards. Guests should not leave any items at the Property and, if left, the Owner has the right to charge for the removal, return or disposal of those items.
Damage, Loss, Theft: Guests agree to inform Owners of any damage or loss however caused, excluding reasonable wear and tear incurred during occupation. Guests should not remove any item from the Property. The Owner may ask for reasonable replacement costs. Nuisance: Guests should not cause nuisance or annoyance to occupants of any nearby Property. If
If, in the opinion of the Owner, any person is not suitable to continue their occupation of the Property because of unreasonable behaviour, damage or nuisance, the contract may be treated by the Owner as discharged and the Owner may repossess the Property immediately. The Guest will remain liable for the whole cost of rental and no refund shall be due.
Access: Guests must allow reasonable access to the Property by the Owner for maintenance given reasonable notice.
Wildlife:Property is located in open countryside. Please therefore expect to encounter various forms of wildlife, which may include occasional insects such as spider, fly, horsefly or wasp or small mammals and birds, which may be in or around the curtilage of the Property unbeknown to the Owner. Spiders in particular are not considered to be a pest and consume up to 2000 other insects per year. If such creatures as listed might constitute being a nuisance, it would be best not to book the property. Owners reserve the right to take no action if they consider the existence of the wild life not to be a serious threat to human health.
Please note, the Guest is a consumer, and therefore has rights in relation to the booking. Advice about those rights is available from Citizens’ Advice Bureau or Trading Standards. Nothing in these Terms and Conditions will affect these rights.
Disputes: Any dispute arising out of the booking will be between the Guest and the Owner. No complaints can be considered unless notified during the Guest's stay in the Property. It is the duty of Guests to minimise any loss to them and therefore it is their responsibility to inform the Owner at the earliest possible opportunity of any problem.
The Guests custom is valued however failure by the Guest to notify the Owner of any complaint during their stay or shortly after will entitle the Owner to refuse such complaint.
Liability: The Owner cannot accept responsibility for any material loss, damage, additional expense or inconvenience directly or indirectly caused by or arising out of the Property, its plumbing, gas, electrical services or exceptional weather.
No responsibility is accepted for death, injury and loss or damage of Property, (including pets), vehicles or vehicle contents belonging to the Guest or any member of the party during their occupancy. The Property has external CCTV surveillance. security alarm and coded electric gate installed . These measures installed by the Owner for the protection of the Property and Guests.
The maximum liability accepted by the Owner will be the total cost of the holiday as paid by the Guest to the Owner. No other expenses such as travelling costs or alternative accommodation will be accepted.
Cancellation by Owners: The Owner reserves the right to refuse any booking and to cancel any bookings already made, if the Property become unavailable for any reason whatsoever, including perils such as fire and flood, subject to a full refund of all monies being repaid. The Owner shall not be under any other liability, should such a cancellation occur.
Precautions: The Property is located within a former farm yard surrounded by arable fields. At certain times of the year farm machinery will be operating within the surrounding fields and using the access track. The Owner will provide a map of the perimeter of the Property detailing the Property boundary. The Owner is not responsible for any death, injury and loss or damage (including pets) by the Guest and party venturing beyond the property boundary. Farming operations are attractive to children and the Owner insists that the Guest supervise children at all times, especially in the circumstance of farm machinery operating nearby. Whilst the operators will at all times, look to mitigate the impact of their work on the property, for Health and Safety reasons, we would ask for the Guests to stay inside with windows closed, when the Sprayer is operating in close proximity and when the Combine Harvester is creating a lot of noise and dust. Harvest only comprises two to three of days a year when tractors with corn trailers will use the access track.
No Smoking: The Guest must not smoke in the Property. There is a designated smoking area outside in the courtyard for Guests.
Force Majeure: The Owner cannot accept responsibility or liability for any alterations, delay or cancellation or any other loss or damage caused by war, civil strife, terrorist action, industrial disputes, fire, sickness, bad weather, epidemics, acts of any government or public authority, or any other event outside our control.
Waiver: The failure of the Owner to enforce or exercise, at any time or for any period of time, any term of, or any right pursuant to this agreement does not constitute and shall not be construed as a waiver of such term or right.
Miscellaneous: The Guest agrees that the contract with the Owner is made at the Owner's premises and that any proceedings between the parties shall be conducted in the County Court nearest to the Owner.
